Mumbai I Commissionerate issued Order on 9th Feb 2012 directing all the Control Room Officers (Inspectors of Central Excise) to sit at entry gate of the Building where, Mumbai Zone-I Chief Commissionerate, Mumbai I Commissionerate, Mumbai I Service Tax and Mumbai II Service Tax Commissionerate staff working. The directions are more than derogatory to the dignity of Central Excise officers (Inspectors). If any one goes to court certainly the concerned Commissioner / Addl. Commissioner will be found in wrong footing for using such a language. The AICEIA President and SG should takeup the matter with CBEC Chairman/Revenue Secretary.
As if it is not enough, the CROs are directed to sit at Gate, which is just at the entry of building, (all Cars halts ther for alighting and boarding of officers, this is just 3.5 Mtrs from the footpath at Churchgate Railway station opp. This is nothing but an act un application of mind without requirement of such method and human dignity. At Mumbai Police Commissionerate office, there is a Control Room where the Sub Inspectors sit and manage the entire in and outflow of the staff and public.
The Governer of Maharashtra is attended by a Police Inspector for his Bunglow and personnel secutiry.
The Sitting of an Inspector in Uniform at a open place before the public eyes for security purpose by an official order is a fit case for CAT. If the Commissioner is not withdrawing the order in 7 days time, this association will not leave that option of getting a direction from the Court.
The All India Central Excise Inspectors Association is part of the JAC of Staff Associations in CBEC. The JAC in its recent meeting has taken a decision to undertake agitational programme for achieving the demands. the poster below is self explananetory. The Inspector cadre is not only in existence from the Day the Govt. of India came in to existence but in British India & Provincial Govts. also. But Inspector Recruitment Rules came into existence for the first time in 1979 and again New Rules were framed in 2002 (amendments made onece or twice in between) and 2002 RRs are valid as on date. Let us examine the Rules also, how they were further complicated in management of Inspector Cadre:
1. RR is One for entire CBEC (whole of India) and strength of the cadre (say X) is defined in the RRs itself.
2. There is No mention in the RRs for any sub - cadres or split of Single Cadre in to Multiple Zones/Regions in the RRs.
Only, the Examination for Recruitment was being conducted by the Central Recruitment Agency Staff Selection Commission on Zonal / Regional basis, selecting candidates recommending for appointment to Dept. as per Zonal / Regional merit till 2005. After the Hon'ble Supreme Court Judgment in 2005, the selection Exam become All India Merit based and the candidates are being distributed by CBEC as per the options available at various formations.
Here. the question is: How CBEC is resorting to regional seniority and split the one cadre Inspectors in to so many Zonal / Regional cadres, in the absence of any provision of RRs. Even if they did a wrong by any means, why they are averse to correct the same in the interest of the Cadre officers (as it is not affecting the Board or the IC&CE cadre). What the cadre wants the Board to do in this matter is recast the seniority of Inspectors at All India level so as to bring proper cadre management. This is otherwise, we may call base cadre seniority for promotion to next level as per the Rules in force.
The Second issue from the lower level to be attended is Merger of Three Single but separate Cadres in the Executives vice 1. Central Excise Inspectors 2. Preventive Inspectors and 3. Examiner Inspectors in to a Single Cadre based on the Functional similarity (as recommended by the CPC time and again) and the SRP commission recommendations, based on which the Customs Group A Service and Central Excise Group A Service has been merged in 1989 and new RRs were framed for the Group A service as IC&CE Service. Since the Dept. failed to merge the Lower level cadres in 1989, the IC&CE cadre continued to drain the promotional source of Superintendents of Central Excise (incl. other feeder cadres) and further deprived To end the system of irregularity and disparity in promotional career various Committees were appointed and the reason for disparity has been identified by the Govt. very long back. But due to continued neglect towards the stagnation of Central Excise Executives, today the situation is, a large gap in promotions within the Executives. The Examiners of 1988 batch are working as Asst. Commissioner. 2. The Preventive Officer promoted in 1996 as Su pdt. also working as Asst. Commissioner and 3. The Inspector of Central Excise of 1975, promoted in the year 1991 not yet promoted to Asst. Commissioner Grade (60% of them retired as Superintendents)
